1. Agreement to Terms

Welcome to Tales Together. These Terms of Service ("Terms") govern your access to and use of the Tales Together website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms and, in some cases, provide additional notice (such as adding a statement to our homepage or sending you an email notification). Your continued use of the Services after the changes have been made will constitute your acceptance of the changes.

4. Account Registration and Security

Our Services allow you to create personalized stories and upload content, including text, images, and other materials ("User Content"). You retain all rights in your User Content, but you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, and otherwise exploit your User Content in connection with operating and providing the Services.

You represent and warrant that:

  • You own or have the necessary rights to your User Content and have the right to grant the license above
  • Your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or other rights
  • Your User Content complies with these Terms and all applicable laws and regulations

6. Prohibited Conduct

You agree not to:

  • Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services
  • Use the Services in any way that violates applicable laws or regulations
  • Upload or transmit viruses, malware, or other types of malicious software
  • Attempt to circumvent any content-filtering techniques we employ
  • Attempt to access or search the Services through the use of any engine, software, tool, agent, device, or mechanism other than the software and/or search agents provided by us
  • Collect or store personal data about other users without their express permission
  • Use the Services for any illegal or unauthorized purpose
  • Use the Services to create content that is offensive, harmful, or inappropriate

7. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Tales Together, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. Subscription and Payment

Some of our Services may require payment of fees. When you purchase a subscription or make a one-time payment, you agree to pay all fees in full. All fees are non-refundable except as required by law or as otherwise specified at the time of purchase.

We may change our fees at any time. If we change our fees, we will provide notice of the change on the website or by email, at our option, at least 14 days before the change takes effect. Your continued use of the Services after the fee change becomes effective constitutes your agreement to pay the changed amount.

9. Termination

We may terminate or suspend your access to all or part of the Services, with or without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms, applicable laws, or is harmful to the interests of another user, a third party, or us.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Tales Together BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.

12. Governing Law

These Terms and your access to and use of the Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Tales Together is established, without regard to its conflict of law provisions.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the jurisdiction in which Tales Together is established.

14. Entire Agreement

These Terms constitute the entire agreement between you and Tales Together regarding the use of the Services, superseding any prior agreements between you and Tales Together relating to your use of the Services.
